ParaBOLT Terms of Use

1. Acceptance of these Terms
These Terms of Use govern your use of the ParaBOLT application and related ParaBOLT services.
By downloading, accessing, purchasing access to, or using ParaBOLT, you agree to these Terms of Use.
If you do not agree to these Terms, do not use ParaBOLT.
2. About ParaBOLT
ParaBOLT is a breathing-training application designed to provide guided breathing exercises, breath-hold training, BOLT score tracking, saved training programs, and related training features.
ParaBOLT is intended as a wellness and breathing-training tool.
3. Age requirement
ParaBOLT is intended for adults aged 18 years and over.
By using ParaBOLT, you confirm that you are at least 18 years old.
4. Health and medical disclaimer
ParaBOLT is not a medical device and does not provide medical advice, diagnosis, treatment, or emergency medical services.
Information, training recommendations, BOLT scores, breathing exercises, breath-hold exercises, statistics, and other content provided through ParaBOLT are for general wellness and training purposes only.
A BOLT score or other information generated by the application should not be interpreted as a medical diagnosis or assessment of a health condition.
If you have a medical condition, concerns about your health, or are unsure whether breath-hold training is appropriate for you, seek advice from an appropriately qualified healthcare professional before using the training features.
Do not delay seeking professional medical advice because of information provided by ParaBOLT.
5. Breath-hold training and safe use
Breath-hold training can create temporary physical sensations including an increased urge to breathe, discomfort, light-headedness, or dizziness.
Use ParaBOLT responsibly and remain within your personal comfort and ability.
Do not force breath holds or deliberately push yourself beyond a level you can safely control.
Stop a session immediately if you feel unwell, dizzy, faint, unusually short of breath, or experience any other concerning symptoms.
Breath-hold exercises should only be performed in a safe environment.
Do not perform breath-hold exercises:
- in water;
- while driving;
- while operating machinery; or
- in any situation where dizziness, distraction, or loss of awareness could cause injury to you or another person.
You are responsible for deciding whether a particular exercise, duration, training configuration, or level of intensity is appropriate for you.
6. No guaranteed results
Individual responses to breathing and breath-hold training vary.
ParaBOLT does not guarantee that use of the application will produce any particular improvement in BOLT score, breathing efficiency, carbon dioxide tolerance, fitness, wellbeing, performance, relaxation, or other outcome.
Training results may vary between individuals and over time.
7. Subscriptions and paid access
Certain ParaBOLT functionality may require a paid subscription.
Where a subscription is offered through Google Play, the current price, billing period, introductory offer or free trial, if applicable, and other purchase information will be presented through Google Play before you confirm your purchase.
Subscriptions may automatically renew unless cancelled in accordance with the conditions presented at the time of purchase.
Payments are processed by Google Play. ParaBOLT does not receive or store your payment card or other payment-method details.
8. Free trials and promotional offers
ParaBOLT may offer free trials, introductory pricing, or other promotional subscription offers from time to time.
Eligibility, duration, pricing, renewal conditions, and availability of any offer will be displayed before purchase.
Unless otherwise stated when the offer is accepted, a trial or promotional period may convert to a paid subscription at the applicable subscription price if it is not cancelled before the end of the trial or promotional period.
Offers may be limited to eligible users and may change or be withdrawn for future customers.
9. Managing or cancelling subscriptions
Subscriptions purchased through Google Play can be managed or cancelled through your Google Play subscription settings.
Cancelling a subscription stops future renewals. Unless otherwise required by applicable law or Google Play's applicable policies, cancellation normally does not immediately remove access already paid for, and access may continue until the end of the current subscription period.
Deleting ParaBOLT from your device does not by itself cancel a Google Play subscription.
Refund eligibility is determined in accordance with applicable law and the policies of the platform through which the purchase was made.
10. Application availability and updates
We aim to keep ParaBOLT available and functioning reliably, but uninterrupted or error-free availability cannot be guaranteed.
The application may occasionally be unavailable because of maintenance, technical problems, platform changes, Google Play services, device compatibility issues, or circumstances outside our reasonable control.
ParaBOLT may be updated over time to correct problems, improve reliability, maintain compatibility, improve the user experience, comply with legal or platform requirements, or modify application functionality.
11. Device compatibility
ParaBOLT requires a compatible device and operating system.
Features may behave differently depending on device hardware, Android version, system settings, accessibility settings, audio configuration, vibration capabilities, Google Play services, and other device-specific factors.
You are responsible for maintaining a compatible device and any internet connection required for Google Play or subscription functionality.
12. Local application data
ParaBOLT stores certain training information and preferences locally on your device.
This may include BOLT score history, saved training programs, training statistics, application settings, and related application information.
ParaBOLT does not currently provide a developer-operated cloud account or cloud synchronization service for this training information.
You are responsible for maintaining your device and any backups you choose to use.

13. Third-party services
ParaBOLT may rely on services provided by third parties, including Google Play and Android platform services.
Your use of those services may also be governed by the applicable third party's terms, privacy policies, and other conditions.
ParaBOLT is not responsible for services operated independently by third parties.
14. Intellectual property
ParaBOLT, including its application design, branding, logo, software, text, graphics, audio assets, training presentation, website content, and other original material, is owned by or licensed to the developer unless otherwise stated.
Your subscription or access to ParaBOLT provides you with a personal, limited, non-exclusive, non-transferable right to use the application for its intended purpose.
It does not transfer ownership of ParaBOLT or its intellectual property to you.
15. Acceptable use
You must not:
- attempt to interfere with the normal operation or security of ParaBOLT;
- attempt to gain unauthorized access to application systems or services;
- reverse engineer, reproduce, redistribute, resell, or commercially exploit ParaBOLT except where such restriction is prohibited by applicable law;
- use ParaBOLT for unlawful purposes; or
- use the application in a way that infringes the rights of another person.
16. Privacy
Your use of ParaBOLT is also subject to the ParaBOLT Privacy Policy.
The Privacy Policy explains what information is stored, how information is handled, the role of Google Play and Android services, and how you can contact the developer regarding privacy matters.
17. Consumer rights
Nothing in these Terms is intended to exclude, restrict, or modify any consumer guarantee, right, remedy, or other protection that cannot lawfully be excluded under the Australian Consumer Law or other applicable consumer-protection legislation.
Where applicable law provides you with rights or remedies that cannot be excluded by agreement, those rights and remedies continue to apply.
18. Limitation of liability
To the maximum extent permitted by law, ParaBOLT and its developer are not liable for indirect, incidental, consequential, or special loss arising from the use of, inability to use, or reliance on the application.
You remain responsible for using breathing and breath-hold training features safely and appropriately.
Nothing in this section excludes or limits liability where doing so would be prohibited by applicable law.
19. Ending your use of ParaBOLT
You may stop using ParaBOLT at any time.
Uninstalling the application does not automatically cancel an active subscription. Subscriptions must be cancelled through the applicable subscription-management method.
We may restrict access to ParaBOLT where reasonably necessary to prevent unlawful use, misuse, security threats, or serious violations of these Terms.
20. Changes to these Terms
These Terms may be updated when ParaBOLT's functionality, subscription arrangements, legal requirements, or business practices change.
When the Terms are updated, the effective date shown at the top of the Terms will also be updated.
Where required by law, material changes will be communicated appropriately.
21. Governing law
These Terms are governed by the laws applicable in Queensland, Australia, and the Commonwealth of Australia.
Nothing in this section limits any mandatory rights or protections available to you under the laws that apply where you live.
